TRUSTS
Although Malta is a civil law system and trusts originated in common law systems trust legislation features prominently in Maltese law. Trust legislation was initially introduced in Malta by Act XXXV of 1988. Important developments were made in 1994 and more recently by virtue of the Trusts and Trustees Act, 2004.
Under the Trusts and Trustees Act both Maltese residents and non-residents alike may set up various types of trusts contemplated by the Act. Trusts set up under the previous legislation have been afforded a ten-year period from date of registration to comply with the Trusts and Trustees Act.
The Trusts and Trustees Act also incorporates the Convention on the Law Applicable to Trusts and on their Recognition (Hague Convention) whereby trusts whose proper law is not Maltese law may be recognised as trusts in Malta.
